We Will Not Tolerate Having Our Rights Violated

CAL fleet service workers, mechanics and pilots rallied outside CAL headquarters in Houston last Monday, January 4 demanding a stop to the company’s sleazy anti-union campaign, and demanded fair bargaining. In Newark, our co-workers, Congressman Donald Payne (D-NJ) and Teamster International Union Vice President Fred Potter delivered a strong letter to CEO Jeff Smisek with similar demands. CAL response to our campaign to form a union continues to strengthen our resolve to win and build a strong union.

ScottIn a letter to us, our CAL Committee for Victory is urging us to stay strong, calm and focused as management unleashes its anti-worker, anti-union, voter-suppression campaign.

On Monday, three of our coworkers testified before the National Mediation Board (NMB) about unfair union election rules. Earlier in the year, the NMB proposed changing those rules to make them more fair for employees in the airline and rail industries. Under the proposed rules, union representation would be determined by the majority of voters instead of the majority of the bargaining unit, which is how the rules are currently set. Although we are moving forward with our campaign and a change of rules will not affect us, we feel testifying before the NMB was the right thing to do because it shows our support to other workers like us to want to form unions.

From the beginning of this campaign, CAL has violated our rights as workers by trying to limit each form of communication available to us in forming our union. Now, in an effort to curb worker exchanges during this campaign on our highly successful Facebook group, CAL has passed a suppressive policy on electronic communications.

The company’s new electronic communications policy is so broad and vague that it provides virtually no effective guideline to workers on permissible speech. This new policy is a blatant un-American, anti-democratic attempt to shut us up. It is highly suspect that this policy was released during the union election period while our Facebook group becomes more popular. It is clear that CAL believes we are winning and is willing to violate our rights in an effort to censor our Facebook group.

We have not permitted CAL to shut us up so far in our effort to form our union and we are not going to let this new policy impact our efforts. We will fight this policy in every appropriate, thoughtful and, of course, legal manner.

The bottom line: This policy violates the freedom of speech and association of every CAL employee regardless of job class. These are precious rights and we will not permit CAL to take them away from us.
